Rush's ex-girlfriend, who has not been identified for legal reasons, was confronted by him at the Anderson Mill Pub as she was apparently not talking to him. They had broken up about a month and a half ago after three years of dating, according to Fox 7 Austin. Local councilmember Mackenzie Kelly posted a surveillance video to Twitter, showing Rush placing a leather satchel on top of the bar counter. A police affidavit stated that his ex continued to refuse to interact with him when he arrived at the bar. At some point, he pulled out a pistol and pointed it at her. A red dot from a laser sight was seen pointed right at her chest. He then proceeded to fire and barely missed her. 

The affidavit also states that Rush fired at least three shots before he was pinned by others present. One of the shots smashed a bar mirror behind where his ex was standing. Speaking to KVUE, one of the bar patrons who pinned the lawyer said he even tried to shoot himself in the head but failed when they got between him and the trigger. The customers kept him on the ground until police arrived at the scene. "We're all just lucky," one of them told local news outlet after the incident. "That could have gone down so differently than it did. Thank God," they added.

In the aftermath of the shooting, Rush's profile page was wiped from the website of Peiffer Wolf Carr Kane & Conway, the law firm where he worked. "Gavin Rush no longer works at the firm," the company said in a statement. "We do not tolerate hatred or violence of any kind. Our thoughts are with the victims who experienced a significant trauma that day," the statement added.

That said, local politicians and members of law enforcement were alarmed at Rush's ability to get out of prison so quickly. Speaking to Fox 7 Austin, Thomas Villareal, head of the Austin Police Association, said, "This particular case seems to be one where the courts have failed this victim." Travis County District Attorney Jose Garza blamed a municipal judge when asked about the low bond set. "I don't know what information the magistrate had in front of them when they made that decision," he told CBS Austin. "Under state law and under local practice, the District Attorney's Office and prosecutors generally are not present at the setting of bail. That is something that municipal judges do without input from the District Attorney's Office," Garza added.

According to Rush's LinkedIn, he works on "sexual assault, embryo destruction and fertility center misconduct, complex commercial litigation, civil rights actions, FINRA arbitrations, and financial services disputes." As mentioned, he was charged in 2017 with assault/family violence by impeding breath/circulation against another woman in a different county. However, he had the case dismissed after completing anger management classes, per KVUE. It's worth noting that the judge granted Rush's ex an emergency protection order against him when the bond was set, per the Daily Mail.
